We bring to your notice that certain service providers offering certain services may require that you append to their liability waiver before requesting, subscribing or purchasing those services.
You may forfeit the following if you violate any warranties or commitments set out by suppliers:

TRAVEL LOCATIONS
Please be aware that travel risk varies in different countries and that natural disasters could coincide with your travel itinerary. You are therefore urged to take all necessary precautions, and measures as well as heed to announcements by relevant authorities. FlyBudu will not be held responsible for injuries suffered, nor loss or damage that may arise out of travel to places of risk. FlyBudu will not be held responsible for acts of God, force majeure, acts of government or authority that might interfere with your travel. FlyBudu, our subsidiaries, agents, partners do not contract that the dissemination of information through this website would be accurate. FlyBudu will take all responsible steps to transmit up to date information on its website but will not be held responsible for errors on airline’s related operational services, booking prices, ratings, product and packages. We will take all responsible steps to correct error made on pricing list and reservation made based on those errors and we grant that we will be able to keep such reservations at the available price at your option and at no cost. The choice for opting for any of these products and services contained on this website are yours and FlyBudu is not obliged and does not represent or make recommendations of products and services displayed on its website or by its affiliate. FlyBudu and its affiliate would not be held liable for erroneous and fraudulent mails sent through its websites, servers and companies and we maintain that our sites are free from viruses. FlyBudu disengages itself from damages of property injuries to persons, acts and omissions, breaches, errors or deaths arising from the acts of independent contractors, who are not agents of FlyBudu and its affiliates. TRAVEL LOCATIONS
It is strongly advised that all clients have sufficient insurance cover in order to cover instances such as cancellations due to illness or injury, personal accident, and personal liability, loss of or damage to baggage and electronics. (Note that this is not an exhaustive list) FlyBudu will not be responsible or liable if the Client fails to take adequate insurance cover. It shall not be obligatory upon FlyBudu to effect insurance for the Client (since this service do not fall within the scope of the Services) except upon detailed instructions giving in writing by the Client. All insurance effected by FlyBudu pursuant to such instruction will be subject to such exceptions and conditions as may be imposed by the insurance company or underwriters accepting the risk. FlyBudu shall not be obliged to obtain separate cover for any risk so excluded. Should the insurers dispute their liability for any reason, the Client will have recourse against the insurers only. Please not that various credit card companies offer limited levels of travel insurance, which in FlyBudu’s view may not be sufficient cover for international travel The Client is advised to check their respective credit card companies in order to obtain the specific details of the cover offered and determine whether this is sufficient for the Client’s requirements.
COVID 19 DISCLAIMER
By proceeding to book You agree and accept the Terms and conditions of FlyBudu’s Website. You further acknowledge that FlyBudu operates as a reseller of flights, therefore all contents that appears on our website is secured from a GDS (Global Distribution Service) or from the airline directly through an Application Programing Interface (API). Whilst every effort is made to ensure that systems are updated to take into account any travel restrictions that may exist at the time of booking, it may be possible that there is a delay in the GDS or Airline system to accommodate all travel restrictions that may be imposed. By booking the selected flight with us, you confirmed that you have checked that there are no travel restrictions, in both your country of departure, transit and arrival, that you have satisfied yourself that you can proceed with the booking. Please also check the entry requirements of your destination country as a quarantine period or testing might be a requirement when flying from Nigeria. FlyBudu cannot be held liable for any operational changes, cancellations or consequential damages incurred by you or any passenger in the booking, in the event that flights are not able to operate as planned, including any disruptions, cancellations, or changes to planned schedules. Please note that in the event that a flight is disrupted or cancelled due to travel restrictions being imposed that each airline will have their own policy in this regard, which will apply to your booking.
NATURE OF SERVICE PROVIDED BY FLYBUDU
FlyBudu renders the service of hosting an online search and booking portal, with its primary focus on the travel and accommodation industries (the services) pursuant to which the general public shall;
- have access to the portal,
- be entitled to set certain travel, accommodations and/or other service criteria based on information gleaned from the internet,
- request quotations and
- be entitled to confirm bookings and place reservations relating to travel, accommodations and/or other service requirements.
For the avoidance of doubt, the service does not include any advisory or consultancy services, unless you choose to speak to a FlyBudu Agent.
FIDUCIARY AGREEMENT
FlyBudu provides client with the service either itself or acting on behalf of principals engaged in or associated with the travel and or accommodation industries, such as airlines, hotels, or other service providers (collectively referred to as “principal”). FlyBudu represents the principal as agents only and accordingly accept no liability for any loss, damage, injury, illness, harm or death(except if such loss or damage arise from the gross negligence or willful misconduct of FlyBudu or any person acting for or controlled by FlyBudu), which any client may suffer as a result of any act or omission on the part of or the failure of the principal to fulfil their obligations, whether in relation to travel arrangements, accommodation or otherwise. When you make a booking with us, you agree that we act only as an agent for the third-party service provider, which is solely responsible to provide you with the service which you have booked. The contract in use by the principal (which is often constituted by the ticket issued by the principal), shall constitute the sole contract between the Principal and the Client and any right of recourse the client might have will solely be against the principal. FlyBudu shall, as soon as possible after the confirmation of the clients booking, reveal the principal’s identity to the client. Be advised that when booking a travel package with FlyBudu, either online or through Live agent, it is the passenger’s responsibility to ensure that they have familiarized themselves with all terms and conditions that are applicable to their booking, which may include all transport services suppliers. In the instance where a unique travel package has been requested and built specifically for a passenger, FlyBudu does not guarantee the service or refundability of the booking. It is the passenger’s responsibility to confirm that he/she has satisfied him or herself as to the terms and conditions of all suppliers involved in the booking. Periodically, FlyBudu may together with a partner, offer exclusive promotional deals, which will only be available to a select few, based on a qualifying criterion. In this case, specific terms and conditions will apply which will be made known to you. It is the Clients responsibility to familiarize themselves with the principal’s terms and conditions.
THIRD PARTY SERVICE PROVIDERS
In the extremely improbable event that the final itinerary needs to be extended due to flight rescheduling, bad weathers, flight delay, strikes or any other cause which is beyond the control of FlyBudu, its agent or its principal, any expenses relating to such unscheduled extensions (hotel accommodation, missed business opportunity etc.) will be from the Clients account. The client should confirm whether any of these expenses may be covered by travel insurance, should this be applicable, it is the Client’s responsibility to confirm the specific provisions of the travel insurance. In most instances, the principal will make the changes known to FlyBudu and in this instance, time permitting, FlyBudu will make every effort to pass this information using the contact details you provided at the time of booking. Please note that it is the principal’s duty to inform the person who made the booking of any changes in regard to the above booking. Moreover, there are times when this information is not timeously relayed, so it is important to ensure that when travelling you have access to the email address used at the time of booking. It is also recommended that you confirm your flight itinerary both 72 hours or 24 hours before departing from your country of origin and before return trips. FlyBudu shall not be responsible for failing to advise you of any changes, even when these changes have been communicated by the principal to us as they may be delay in relaying this information to you, due to operating hours or technical delays.
BOOKING ENQUIRIES AND RESERVATIONS
Once the Client has completed all applicable fields to initiate an inquiry regarding a particular destination, trip, tour, mode of travel, preferred accommodation and/or other service on FlyBudu’s website or mobile application (“the sites), the sites will prepare and provide the client with the projected total cost of the enquiry (online, by E-mail, by sms or telephonically) (the quote). The Quote is accepted by the client when the client proceeds with the steps as specified on the sites or accepts the quotes telephonically or through Email or Writing. Full payment of the total value of the payment (Quote) is required in order to confirm reservations with the relevant principals (“the booking”). Once the online booking or booking affected by FlyBudu has been completed and the client have authorized FlyBudu to process the payment by submitting the booking for reservations, the client will be supplied with an email that will contain the final details of the booking (‘the booking confirmation form). In the case of air tickets, full payment for the bookings needs to be made and reflect in the bank account of FlyBudu Ltd before the tickets can be issued. This must reflect prior to 9PM on the day of making the booking. Until FlyBudu has confirmed the payment as received and paid in full and has sent the ticket, the itinerary, seats and fares as they were quoted in the booking confirmation form are not Guaranteed. Note that all tickets carry different fare conditions as imposed by the relevant airline. The tickets you are purchasing may only be partially or non-refundable. To verify this before booking online please contact our services.
PASSPORTS, VISAS AND HEALTH
It is entirely the client’s responsibility to ensure that all passports and visas are current, valid, obtained on time, have sufficient blank pages, will be valid for 6 months after return to their home country, and that any vaccinations, inoculations, have been obtained. The Client is strongly advised to check the relevant requirements for their destinations and any transit countries before booking any flight and before traveling as requirements may change. Please be advised that transit visas usually take between 5-7 working days and sufficient time should be allowed to acquire such a visa if required.
DESTINATION SELECTION
The Client acknowledges that they have selected the itinerary and destination(s) constituting the booking based on information gathered from the internet. They also acknowledge that the internet booking has been compiled and is managed and updated by the principal, and that FlyBudu has no control over information compiled by the principal. Accordingly, Flybudu cannot and does not Guarantee that the itinerary and/or any destinations will comply in whole or in parts with those advertised on the internet by or on behalf of the principal. Any right of recourse in that regard will be against the principal. Moreover, FlyBudu cannot be liable for incorrect availability being displayed by the principal and FlyBudu cannot be held liable if the seats selected are not available. FlyBudu will endeavor to assist the client if requested, but such assistance will be at FlyBudu’s discretion (since this does not fall within the scope of our services), and the client contracts that in doing so, FlyBudu is not assuming any obligation or liability and the client indemnifies FlyBudu of any consequences of the client’s failure to comply with any such requirements. It is the Client’s duty to familiarize him/herself with the inherent dangers of and mental and/or physical condition required for the proposed travel arrangements.
PAYMENT AND PAYMENT TERMS
The payment is due immediately by Visa, Mastercard, Quickteller, Paystack, Monnify, electronic funds transfer, Verve, American Express, Diners Credit Card, Cash Deposit at Bank, and Cash payment to Kiosk teller for kiosk booking. These payments must reflect in the bank account of FlyBudu Ltd before a ticket can be issued. If the payment is not received as stated above, FlyBudu reserves the full right to cancel the booking, in which event the full payment (less any cancellation or administrative fees) shall be refunded to the client 72 business hours of the cancellation being processed In the event that the payment was not confirmed to have been received in time and should FlyBudu inform the client by means of a revised quote that the booking remains available at a higher price, the Client may choose to proceed with the booking at such higher price. In which event the client will be liable for any difference between the original quote and such higher price, and the revised payment must reflect in the bank account of FlyBudu before the deadline stipulated in the revised Quote in order to secure the booking. FlyBudu is a Nigerian company, and all transactions are processed in Nigeria Naira or American dollars (USD). The applicable conversion charges (additional charges) may therefore be levied by your merchant bank if payment is made from another country and/or in another currency. The additional charges are driven by the global treasury of the applicable credit card and are impacted by the change in daily exchange rates. FlyBudu shall therefore not be held liable for any additional charges levied by the applicant merchant, or bank pursuant to the confirming of a booking.
QUOTES
Quotes are provided at the ruling exchange rate. Until FlyBudu has received payment and the principal has issued the ticket, we reserve the right to amend any quote. Should the Quote be increased as a result of exchange rate fluctuation, the Client undertakes to pay for any increase on demand. The burden will be on the client to check that they have been no changes in the quote prior to making the payment. Airfares are subject to the price and conditions quoted by the airlines. Should the client be a group booking and the group number deviate from the number required from the booking, the principal may reserve the right to re-cost the quote and raise a surcharge. Should any client refuse to accept and pay such surcharge, it may result in the principal cancelling the booking and retaining any payment made, FlyBudu will be entitled to retain any service fees charged.
SERVICE FEE
These fees cover the cost incurred by FlyBudu in booking and servicing your travel reservations. We also reserve the right to charge an additional service fee for transaction cost incurred from payment gateways and any additional services rendered, such as cancellation request and changes to your booking. Please be advised that services and products are non-refundable in case of a cancellation. Service fees vary, they depend on the number of passengers in a booking, the service provider or the destination and the service provided. Should you book online these fees will be clearly displayed on the payments page before your booking is confirmed. Should you book with an agent, these fees will appear in your quotation.
AMENDMENT FEE
An amendment fee per booking may be levied for any changes to the confirmed itinerary and or ticket. The travel agent amendment fee is charged in addition to any amendment fees which may be charged by the relevant Principal.
INDEMNITY
The proposed travel arrangements are made on the express condition that FlyBudu, its employees and agents shall not be responsible for, and shall be exempt from, all liability in respect of loss, damage(including loss of profits or consequential or special damages), accident, injury, illness, trauma, death, delay, or inconvenience(losses) to any client(which shall be deemed to include the heirs, executors, administrators or assigns of the Client), their luggage, or other property, wherever, whenever and however the same may occur (except if such losses arise directly or indirectly from the gross negligence or willful misconduct of FlyBudu or any person acting for or controlled by FlyBudu, in which case, such claim shall be logged in writing with FlyBudu within 30days after the occurrence of the alleged loss, and such liability shall be limited to the value of the Client’s booking with FlyBudu).
TRAVEL DOCUMENTS
Documents (for example e-tickets, itineraries etc.) shall only be prepared and released to the client on receipt of a valid proof of payment received from the client and confirmation of payment on FlyBudu’s bank account. Any document received prior to the payment and confirmation shall not be deemed final.
NAME CHANGE REQUEST
Upon confirming your booking, we advise you to check your names and ensure that it is as per your passport or identity document. In the event that a traveler’s name is misspelt on their passport or identification document, the airline could deny them access to board the plane or should the traveler require a name change and should it be permissible, airlines penalty may apply. Please note that some airlines do not allow name changes for any reason whatsoever and may require you to buy a new ticket. FlyBudu accepts no liability in this regard.
SPECIAL REQUESTS
Clients who have special requests must specify such requests in writing to FlyBudu at least 48 hours prior to their departure. Whilst FlyBudu will use its finest efforts to accommodate such requests, it does not guarantee that it will always be able to do so.
TRANSFER OF RIGHTS
FlyBudu’s rights and obligations in respect of these terms and conditions contained herein, may be assigned or transferred by FlyBudu to any other related or unrelated entity at any time, whereafter performance of such obligations will become the responsibility of the entity whom such obligations have been assigned to.
CANCELLATIONS
In the event of the client cancelling the booking, FlyBudu shall have the right to either claim the amount of, or retain and amount of the payment and claim reasonable damages suffered by FlyBudu, provided that FlyBudu shall not impose any cancellation fee or claim any damages in respect of a booking or reservation where the client is unable to honor the booking or reservation due to death or hospitalization of the client. The principal may reserve the right to cancel any services prior to departure, in which event the payment (less FlyBudu service fee) will be refunded by the principal to the client without any further obligation on the part of FlyBudu. FlyBudu will charge a fee for processing the refund request. Clients should refer to the “refunds” section of these conditions, as well as the “cancellation” clause contained in the principal’s conditions. Note that principals also reserve the right to charge cancellation fees. Should you have booked a ticket with more than one flight, e.g. (ABV-LGW-HAM) you may only use your ticket in the sequence they were booked. If you do not check in for your first flight, the airline reserves the right to cancel all of the remaining flight on that ticket and your ticket will become invalid. You will not get any money refunded for part of the ticket not used.
REFUNDS
Please be advised that most tickets are non-refundable or partially refundable. Refunds by the principal will be subject to their respective terms and conditions. FlyBudu will charge a fee for processing a request refund. Principals may charge refund fees above these stated here. Some air tickets are completely non-refundable according to the airline fare rules. Cancellations for any reason whatsoever, including medical reasons, death in the family, strikes, wars, natural disasters, airline default, or government, travel warnings will not entitle you to any refund in the case of non-refundable tickets nor of waiving the cancellation policies in case of a refundable ticket. If tickets can be refunded, cancellation penalties are imposed by the airline. Trip cancellation and interruption insurance are therefore highly recommended. For the best coverage, travel insurance should be purchased at the same time as the airline tickets. For flight bookings, the refund will be made by the airline directly to the account the booking was originally paid with. This can take as long as 6(six) months to a year or longer to obtain from the airline. Standard processing time for refunds is 6-8 weeks depending on the airline. For hotel bookings, the supplier will refund FlyBudu and we will refund the credit card you used when making you reservation. This usually takes approximately 4 weeks.
E-TICKETING: DOCUMENT REQUIRED FOR TRAVELLING
It is the Client’s exclusive responsibility to ensure that he/she is in possession of all relevant travel documents prior to commencing his or her travel, including transit visas.
INTERNET BOOKINGS
If the client instructs FlyBudu to effect booking through the internet or telephone, the client irrevocably authorizes FlyBudu to do the following on his behalf;
- Make any selections of and for the proposed travel arrangements
- inform the client of the prices attached to the proposed travel arrangements prior to confirming the bookings.
- Make payments for such booking and ancillary services.
ITINERARY VARIATIONS AND TRANSFERS
While every effort is made to keep the final itinerary, the principals reserve the right to make changes intended for the Client’s convenience. Any such variations in the final itinerary do not constitute any reason for refund and FlyBudu shall not be held liable for any such variations. It is the Client’s Responsible to check every amendment to the Itinerary. Please note that no passenger who has not utilized an outgoing flight on a return ticket will be allowed to make use of the return trip, except when permissible by the airline.
CONFIDENTIALITY
Subject to legislative constraints or Judicial orders, FlyBudu undertakes to treat all personal Clients information private.
CHANGES AND MODIFICATION OF THESE TERMS AND CONDITIONS
FlyBudu could make future modifications to our conditions, information, graphics, products, features, functionality, services, at any time and without notice. The client’s subsequent use of our services after any change is made constitute an acceptance to such modifications. The Client agrees to accept and be bound by the online conditions and notices which are in effect at the time of Client’s use of the sites and facilities.
FEEDBACK
For feedback, you must submit your complaint to us through our dedicated customer experience team within 96(ninety-six) hours of returning from your travel, in order for us to investigate the complaint efficiently and to ensure that we are provided with a fair opportunity to rectify the situation and mitigate any losses or damage. Any and all third-party claims must be made directly with the third-party service provider of the travel product supplied. Stolen or lost luggage must be reported to the airline prior to leaving the airport. We value your feedback. If you have a complaint, please contact our customer care at support@flybudu.com
LEGAL FEES
In the event that FlyBudu has to engage a lawyer to enforce any of its rights in the term and conditions or otherwise, and in the event that FlyBudu is successful in the enforcement of such rights, the Client will be liable for all legal fees at an attorney and own Client scale.
JURISDICTION
These conditions shall be governed by the laws of Federal Republic of Nigeria and under the jurisdiction of Nigerian Court. FlyBudu shall be entitled to institute any legal proceedings arising out of or in connection with this contract in any Nigerian court having Jurisdiction over the matter.
GENERAL
COMMUNICATION FROM SITES
By making a booking on any FlyBudu platform, the client agrees to receive transactional and promotional communications from the sites. The client may opt out of promotional communications at any time, however transactional communication with regard to any booking will be sent.
TERMINATION OF USE
FlyBudu may, in its sole discretion, terminate or suspend your access to all or part of FlyBudu’s website, including, but not limited to any bulletin boards on its site, for any reason, including without limitation, breach of this agreement. In the event this agreement is terminated, the restrictions regarding materials appearing on the site and the representations and warranties, indemnities, and limitations of liabilities set forth in this agreement shall survive any such termination.
ENTIRE AGREEMENT
All the terms and conditions displayed on the sites constitute the entire terms of the relationship between the parties. There exist no other terms, conditions, warranties, representations, guarantees, promises, undertaking or inducements of any nature whatsoever (whether verbal, written, or electronic) regulating the relationship and the Client Acknowledges that he or she has not relied on any matter or thing stated on behalf of FlyBudu or otherwise that is not included herein.
GENERAL PROVISION
If any provision of this agreement is deemed void, Unlawful or otherwise unenforceable for any reason, that provision shall be severed from this agreement and the remaining provisions of this agreement shall remain in force.
